These terms govern your use of the Phase iOS application ("Phase", "the App", "we", "us"). By installing or using Phase, you agree to these terms.

Note on the standard EULA: by default, Apple applies its Standard End-User License Agreement to any app distributed via the App Store. These additional Terms supplement Apple's EULA for the specific topics below. They do not replace it.


1. Not medical advice

Phase is a habit-recovery companion, not a medical device, not a substitute for professional medical or mental-health care, and not a treatment. Quitting smoking, alcohol, or other substances can have medical consequences (including withdrawal symptoms that may require supervision). Consult a qualified healthcare professional before making changes to your habits. If you experience a medical or mental-health emergency, contact your local emergency services or a crisis hotline immediately. Phase's "SOS" feature is a self-regulation tool, not a clinical intervention.

Subject to these terms and Apple's Standard EULA, you are granted a personal, non-exclusive, non-transferable, revocable license to use Phase on Apple devices you own or control.

8. Disclaimer of warranties

Phase is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that Phase will be uninterrupted, error-free, or that streak / savings calculations are precise.


9. Limitation of liability

To the maximum extent permitted by law, in no event shall Jovain Chisholm, contributors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or relapse-related damages, arising from your use of Phase. Aggregate liability for any direct damages shall not exceed the amount you paid for Phase Pro (if any) in the twelve months preceding the claim.

Some jurisdictions do not allow limitations on implied warranties or liability. In those, the limits above apply only to the extent permitted.


10. Termination

You may stop using Phase and uninstall at any time. We may suspend or terminate access to Phase or to Phase Pro features for material breach of these terms.


11. Changes

We may update these terms from time to time. The effective date at the top reflects the most recent revision. Material changes will be surfaced in the app's release notes. Continued use after a change indicates acceptance.


12. Governing law

These terms are governed by the laws of the jurisdiction where Jovain Chisholm is principally located, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction, except where applicable consumer-protection law grants you the right to bring a claim in your home jurisdiction.
